Takeaway(s):
—When the red flag gets hoisted (which it was), and when there’s an appropriate law enforcement response (which there was), there needs to be an unmitigated prosecutorial response (which there wasn’t).
—There needs to be good guys with guns at every venue.
Incident Preventable Factor(s):
—Behavioral Red Flags Ignored/Response Delayed – Perpetrator(s) Expressed Suicidal Ideation and/or Suicide by Police and/or Expressed Violent Intentions Privately and/or Publicly in Person and/or In Any Medium and Criminal Justice System Failures – Prosecutorial Failure – Failure to Pursue Warranted Criminal Charges Against Perpetrator(s) and/or Failure to Petition the Court for a Red Flag Hearing and Unnecessarily Accessible Perpetrator(s) Weapon(s) – Weapon(s) Was Unnecessarily Accessible to the Perpetrator:
“In March 2020, police were called to the home of the perpetrator after his mother reported [he] wanted to attempt ‘suicide by cop.'” “Police seized a shotgun and placed the perpetrator] on temporary hold.” “Prosecutors then decided not to file a petition with the court to add the suspect to the red flag list, because his family agreed to forfeit the firearm.” “That decision ultimately allowed perpetrator to legally purchase two assault rifles months later, which he used …” during the incident. “Multiple prosecutors in surrounding counties say they agree the [Red Flag] law does have some limitations, but they also believe [the prosecutor in this case] still should have filed a petition with the court. We believe this prosecutorial dereliction of duty to be blatant and therefore the points have been doubled. 1 2
Editor’s Note:
The perpetrator said what he was going to do, his mother reported it to the police, the police did their job, and the prosecutor didn’t.
—Venue Lacked Armed Individuals/Personnel – Venue Lacked Armed Individuals (Civilians)/Personnel (Military/Police/Security):
A venue which is “… the company’s second-busiest hub, with nearly 4,000 employees in total,” needs to have armed security. While their perimeter and structural security appears to have been sufficient [given the perpetrator was a former employee] there’s no substitute for armed security personnel.
