Incident Preventable Factor: —Criminal Justice System Failures – Law Enforcement Failure – Delayed Response or Inaction to Perpetrator(s) at Incident Scene: When the shooting started a uniformed off-duty Orlando police officer working a security detail at the nightclub “took cover ” instead of aggressively pursuing the perpetrator.  He told a Police Foundation assessment team that he had immediately recognized that his handgun would be no match for the perpetrator’s rifle. While the police officer did ultimately fire at the perpetrator, he clearly didn’t relentlessly go after him which he should have done.  1 That police officer is the subject of a federal lawsuit that also lists 30 unidentified Orlando police officers who are alleged to have remained outside the nightclub while the shooting occurred inside. 2 Editor’s Note: Florida’s Fourth District Court of Appeal found it was “legally irrelevant” that the perpetrator’s employer (G4S Secure Solutions) had allegedly submitted a fraudulent psychological evaluation to help him get a gun license. 3 Early media reports strongly indicated that the perpetrator’s wife knew what he was going to do, and helped with planning and preparation, including a visit to the incident site with him.
